In compliance with Article 10 of Law 34/2002, of July 11, Services of the Information Society and Electronic Commerce, below are the identifying data of the Holder:

• Any personal data that the User provides via email, online forms or other means will form part of the personal data processing for which HERSILL is responsible. Refusal to provide data marked as mandatory by the asterisk (*) symbol on data collection forms, where applicable, may mean that it is not possible to provide the User with the requested service.
• The purposes of the processing are to provide the services that the User may request; to correctly identify Users requesting personalised services; to carry out statistical analyses to enable improvements to be made to the services provided; to manage job applications and to include them in future recruitment processes that the Data Controller may carry out; to organise training activities; to the management of basic administrative tasks, as well as to the communication, either by email or by any other means, of news, products and services related to HERSILL, provided the User has given their express and separate consent for this purpose.
• Depending on the specific purpose, the legal basis for the processing will be the User’s consent, the implementation of pre-contractual measures requested by the User, the performance of a contractual relationship, or compliance with the legal obligations applicable to HERSILL.
• HERSILL undertakes to treat the User’s data as confidential and will only disclose it to third parties where this is necessary to comply with a legal obligation.  

In order to provide and manage the services associated with the website, certain service providers may access personal data on behalf of HERSILL, acting as data processors and subject to the safeguards and obligations required by the regulations.

• Newsletters and marketing communications are managed via the Mailchimp platform, which involves an international data transfer to the United States, covered by the EU-US Privacy Shield. For further information on the applicable safeguards, please contact HERSILL at info@hersill.com.
• The data will be retained for as long as is necessary to fulfil the purposes for which it was collected and, thereafter, for the duration of the limitation periods applicable to any legal liabilities that may arise.
• The User shall, in all cases, be responsible for the accuracy of the information provided, and HERSILL reserves the right to exclude from the registered services any User who has provided false information, without prejudice to any other legal action that may be taken.
• HERSILL states that it has implemented the appropriate technical and organisational measures to ensure a level of security appropriate to the risk and to protect personal data against destruction, loss, alteration, unauthorised disclosure or access, in accordance with the applicable data protection legislation.

Where processing is based on consent, the User may withdraw their consent at any time, without this affecting the lawfulness of any processing carried out prior to such withdrawal. Furthermore, the User may lodge a complaint with the Spanish Data Protection Agency if they consider that the processing of their personal data does not comply with the applicable regulations.
